EPSON SOFTWARE END USER LICENSE AGREEMENT

IMPORTANT! READ THIS SOFTWARE LICENSE AGREEMENT CAREFULLY. The computer software product, fontware, typefaces and/or data, including any accompanying explanatory written materials (the "Software") may only be installed or used by you on the condition that you agree with and accept the terms and conditions of the Software provider ("EPSON") set forth in this Agreement. The term "Software" shall include the software components, media, all copies made by you and any upgrades, modified versions, updates, additions and copies of the Software licensed to you by EPSON. EPSON reserve all rights not granted herein. By installing or using the Software, you represent that you agree all the terms and conditions herein contained.

1. License. EPSON grants to you a personal, non-exclusive, non-transferrable limited license to install and use the Software on any iPhone or iPad that you own or control. You may not distribute or make the Software available over a network where it could be used by multiple devices.

2. Other Rights and Limitations. To the maximum extent allowed by law or permitted by the licensing terms of any open sourced software used in the Software, you agree not to modify, adapt or translate the Software, or reverse engineer, decompile, disassemble or otherwise attempt to discover or create derivatives from the source code of the Software. You may not share, rent, lease, encumber, sublicense or lend the Software. Any breach of this term shall be subject to prosecution and damages.

3. Ownership. All title, ownership rights, and intellectual property rights in and to the Software and any copies or derivatives thereof shall remain with EPSON. There is no transfer to you of any title to or ownership of the Software and this Agreement shall not be construed as a sale of any rights in the Software.

4. Consent to Use of Data. The Software may connect over the Internet to transmit data and related information to and from your device. You agree that EPSON may collect and use such data and information, including but not limited to technical information about your device, peripherals, system and application software to facilitate the provision of software updates, product support and other services related to the Software to you (if any). EPSON does not collect any personally identifiable information without your permission. EPSON may use collected data to improve its products or to provide services or technologies to you. You further acknowledge that the Software may enable the use of location-based functionality (GPS). To the extent you use the location-based services, you agree that that EPSON and any third party designated by EPSON, may collect, transmit or otherwise use such positioning data for the purpose of providing the location-based services.

The Software may connect over the Internet to in order to update the software version (i) automatically or (ii) with your consent in advance. Such updated software shall be deemed to be the Software and be governed by this Agreement.
