The icon does not mean these sites *are* using the Compability view. The broken-page icon allows *user* to turn on Compatibility view, if the page looks broken (you have to click it and then the icon switches color, and page uses Compatibility view).
The icon is probably enabled by default. If the site declares it as compatible (via HTTP or HTML headers), the icon is not displayed, as in the case of Microsoft.com.
